Will a Criminal Case Just Go Away on Its Own — Myth or Reality?

03.06.2026Reading time: 7 minAuthor: attorney Yuriy Arutyunov

Many people in Moscow who have been given the status of a suspect or an accused hope that over time the criminal case will close on its own. "The limitation period will run out and everything will be forgotten." In practice, this attitude often leads to complications. A criminal defence attorney in Moscow regularly sees situations where delay worsens a person's position.

The limitation period in a criminal case is the period after which the state, as a general rule, loses the ability to hold a person criminally liable. This is governed by Article 78 of the Criminal Code of the Russian Federation. However, the expiry of the period does not happen automatically and does not always mean complete release from the consequences.

These provisions were introduced so that a person is not prosecuted for old events once the public danger has been lost. In reality, however, investigators and courts take many nuances into account. Legal assistance in criminal cases makes it possible to assess the situation correctly and not rely solely on time.

What happens in practice when you wait

If a person does not take active steps, the case may be suspended, a search may be announced, and the periods are in effect extended. As a result, several years later the situation returns, but with additional complications: new materials have been gathered and witness statements have changed.

An attorney in Moscow helps to understand the real prospects and choose a strategy that takes into account all possible scenarios.

What is the limitation period for criminal liability under the Criminal Code of the Russian Federation

Under Part 1 of Article 78 of the Criminal Code of the Russian Federation, a person is released from criminal liability if the following periods have elapsed since the day the crime was committed:

  • two years — after the commission of a crime of minor gravity;
  • six years — after the commission of a crime of medium gravity;
  • ten years — after the commission of a grave crime;
  • fifteen years — after the commission of an especially grave crime.

Limitation periods are calculated from the day the crime was committed until the court's sentence enters into legal force. This is an important rule: even a lengthy investigation does not stop the period from running if there are no grounds for suspension.

The category of a crime is determined by the maximum penalty under the article. For example, if the maximum is up to three years' imprisonment, it is a crime of minor gravity. When analysing a case, a criminal defence attorney in Moscow always takes into account the exact legal classification and category.

Specific features of calculating the periods

If, while the limitation period for the first crime is running, a person commits a new one, the periods are calculated separately for each. For minors, in some cases the periods are reduced by half under Article 94 of the Criminal Code of the Russian Federation.

Important: expiry of the limitation period is a non-exonerating ground. The person is not found innocent but is simply released from liability. If the accused objects to termination on this ground, the case continues in the ordinary way, and the court may deliver an acquittal.

Limitation periods by category of crime and their application

The law clearly links the length of the period to the gravity of the crime. Crimes of minor gravity (up to 3 years' imprisonment) — 2 years. Medium gravity (up to 5 years for intentional crimes) — 6 years. Grave (up to 10 years) — 10 years. Especially grave (over 10 years) — 15 years.

This makes it possible to take a systematic approach. For example, simple theft without aggravating circumstances (Part 1 of Article 158 of the Criminal Code of the Russian Federation) more often falls into the minor or medium gravity category, while fraud on a large scale (Part 3 of Article 159) is a grave crime.

In Moscow, where a large number of cases are heard, a correct assessment of the category helps to predict how the proceedings will develop. The services of a criminal defence attorney include a detailed analysis of the legal classification for an accurate calculation.

Comparing the periods with examples

For minor bodily harm (Article 115 of the Criminal Code of the Russian Federation) — usually 2 years. For theft (Article 158 of the Criminal Code of the Russian Federation), depending on the part — from 2 to 10 years. For grievous bodily harm (Article 111 of the Criminal Code of the Russian Federation) — 10 years. This shows how important it is to know the exact part of the article.

When and how the running of the limitation period is suspended

Part 3 of Article 78 of the Criminal Code of the Russian Federation states that the running of the period is suspended if the person evades the investigation or the court. After detention or a voluntary surrender (confession), the period resumes running.

Evasion means deliberate actions: changing one's place of residence without notification, ignoring summonses, breaching a preventive measure, escape. Being put on the wanted list automatically leads to suspension.

As a result, the actual period during which a person can be held liable may increase considerably. After resumption, the count continues from the remaining time. This is one of the reasons why simply waiting rarely leads to the desired result.

Suspension in practice and its consequences

If the person did not know about the case and was not hiding, the suspension can be challenged. An attorney examines the limitation period in a criminal case carefully, checking the lawfulness of the investigator's decisions. In some cases this makes it possible to have the period resume running in the client's favour.

Suspension is not applied automatically — evidence of evasion is required. Court practice shows that not every absence from one's registered address is considered evasion.

Examples of limitation periods for common articles of the Criminal Code of the Russian Federation

Let us look at specific offences that attorneys in Moscow frequently encounter in practice.

Limitation period under Article 159 of the Criminal Code of the Russian Federation (fraud)

Depending on the part: Part 1 — minor or medium gravity (2 or 6 years), more serious parts — up to 10 years. If the fraud was committed on an especially large scale, a 10-year period may apply. You can learn more about defence in such cases on the page about the services of a fraud defence attorney.

Limitation period under Article 264 of the Criminal Code of the Russian Federation (violation of traffic rules)

Part 1 — minor gravity (2 years). Parts 2–6 are more often of medium gravity (6 years). Where death or grievous harm has been caused, the periods may be longer, but taking the category into account. The services of an attorney in road traffic accident cases help to understand the nuances of legal classification and the periods.

Other articles and calculations

Under Article 115 of the Criminal Code of the Russian Federation (minor harm) — more often 2 years. Article 158 of the Criminal Code of the Russian Federation (theft) — from 2 to 10 years. Article 111 of the Criminal Code of the Russian Federation (grievous harm) — 10 years. Article 112 — medium gravity, 6 years. Each case requires an individual calculation taking all the circumstances into account.

  • Battery and Article 116 — usually 2 years;
  • Hooliganism — depending on the part;
  • Misappropriation (Article 160) — similar to fraud.

A criminal defence attorney in Moscow analyses the materials to determine precisely the applicable period.

Why relying solely on the expiry of the limitation period is a bad strategy

First, suspension can prolong the process indefinitely. Second, over the years new evidence or witnesses may appear. Third, even upon termination due to the limitation period, records remain in databases, and there may be civil claims and reputational consequences.

An active defence makes it possible to achieve termination on exonerating grounds: absence of the elements of a crime, reconciliation of the parties, active repentance. This is far preferable to the non-exonerating expiry of the limitation period.

Comparing the two approaches: passive waiting often ends in court and a criminal record, whereas timely work with an attorney ends in minimising or completely avoiding liability.

What happens if you do nothing

The case may go to court, where the judge will consider it on the merits. Even if the period has almost expired, termination due to the limitation period will not happen automatically without the consent of the accused. It is better to assess the risks in advance with the help of a professional.

The attorney's role in terminating a criminal case on the basis of limitation periods

An experienced criminal defence attorney in Moscow carries out a full analysis: calculates the exact periods, checks whether there have been suspensions, and prepares motions for termination. If the client wants a full acquittal, the defence continues in court.

The services of an attorney in court include representation at all stages and appealing against unlawful actions of the investigator. An attorney defending the accused helps to gather evidence, question witnesses and build a line of defence that takes into account the provisions of Article 78 of the Criminal Code of the Russian Federation.

How the specialist's work is structured

  • Studying the case materials and calculating the periods precisely;
  • Checking the grounds for and lawfulness of the suspension of the limitation period;
  • Preparing motions and complaints;
  • Taking part in investigative actions and court hearings;
  • Appealing against decisions where necessary.

This approach makes it possible not simply to wait but to actively influence the outcome. If urgent help is needed, many attorneys in Moscow offer consultations at a convenient time.
