Today's wide range of goods makes it possible to choose everything needed for the home and everyday life. However, situations often arise in which the quality of goods turns out to be worse than stated. Russian legislation provides for the possibility of a refund for a purchase or an exchange of goods.
Compensation
You may claim compensation in respect of:
1. Food products. The claims that may be brought against the seller regarding the goods depend on how serious the defects are;
2. Non-food products. A refund is possible within 14 calendar days and does not depend on whether you have a till receipt;
3. Services and works.
Under the law, you are entitled to have the result of poorly performed services and works corrected.
As a consumer, you have the right to:
- demand replacement with goods of the same brand
- demand replacement with the same goods of a different brand, with a corresponding recalculation of the purchase price;
- demand a proportionate reduction of the purchase price;
- demand immediate elimination of the defects of the goods free of charge, or reimbursement of the costs of their correction by the consumer or a third party;
- withdraw from the sale and purchase contract and demand a refund of the amount paid for the goods. At the seller's request and at the seller's expense, the consumer must return the defective goods.
Step-by-step action plan:
- Legal analysis of the situation;
- Drafting a letter of claim (from the moment the letter is received, the Seller must respond within 10 days; after this period expires, the Consumer is entitled to recover a penalty of 1% of the amount of the claim and a fine of 50% of the amount awarded to the Consumer by the Court);
- Drafting a statement of claim and filing it with the court;
- Representing your interests in court (until the court decision is enforced).
